鬼頭刀出口應遵行事項
Articles of Procedure for Exporting Mahi-Mahi
一、本事項依漁業法第四十四條第一項第九款規定訂定之。
二、本事項所定鬼頭刀（又稱鱰魚）出口之核准及文件核發等業務，中央主管機關得委任農業部漁業署（以下簡稱漁業署）辦理。
三、出口下列貨品分類號列之鬼頭刀貨品者（以下簡稱出口業者），應依本事項規定辦理：
（一）CCC0303.89.89.42-2「冷凍鱰魚」。
（二）CCC0304.89.90.23-1「冷凍鱰魚片」
四、出口業者出口前點鬼頭刀各批貨品，應於農業部簽審通關共同作業平臺（網址 https://permit.moa.gov.tw）提出申請，於出口前依下列規定上傳文件，經核准後始得輸出，並由漁業署核發漁獲來源證明書（格式如附件）：
（一）輸出國產鬼頭刀，應上傳下列文件，或以上傳臺灣鬼頭刀漁業協會出具之鬼 頭刀輸出證明書替代之：
１、各漁船各航次卸魚聲明書或各定置漁場業者完成定置網漁業查報系統填報 之證明文件。
２、漁業人與出口業者間相關交易流程及證明資料，該資料應具可追溯性。
３、魚貨來源為「臺灣新港鬼頭刀漁業改進計畫」之漁船漁獲物者，應上傳各漁船各航次之漁撈日誌。
（二）輸出他國進口之鬼頭刀，應上傳鬼頭刀貨品之進口證明文件，該證明文件並應加蓋進口之公司及負責人印章。出口業者因故未能於出口前依前項規定上傳文件者，應於該批貨品出口後十四日內完成上傳。
五、依前點規定提出申請，於申請日前一年內有下列情形之一者，得不予核准出口：
（一）依前點規定上傳之申請文件虛偽不實。
（二）未依前點第二項規定完成上傳文件。
I. This matter is established in accordance with Article 44, Paragraph 1, Item 9 of the Fisheries Act.
II. The approval and document issuance for the export of mahi-mahi (also known as sea bass) as stipulated in this matter may be entrusted by the central competent authority to the Fisheries Agency of the Ministry of Agriculture (hereinafter referred to as the Fisheries Agency).
III. Exporters of mahi-mahi products under the following commodity classification numbers (hereinafter referred to as exporters) shall comply with the provisions of this matter:
(I) CCC0303.89.89.42-2 "Frozen sea bass".
(II) CCC0304.89.90.23-1 "Frozen Carp Slices"
IV. Before exporting any batch of mahi-mahi, exporters should submit an application through the Ministry of Agriculture's Joint Operation Platform for Customs Clearance (website: https://permit.moa.gov.tw). Before export, they should upload the following documents according to the regulations. Only after approval can the goods be exported, and the Fisheries Agency will issue a Certificate of Origin of the Catch (format as attached):
(I) For exporting domestically produced mahi-mahi, the following documents should be uploaded, or a certificate of export of mahi-mahi issued by the Taiwan Mahi-mahi Fisheries Association can be uploaded instead:
1. Declaration of unloading of fish for each fishing vessel for each voyage or proof of completion of the fixed net fishing report system by each fixed fishing ground operator.
2. The relevant transaction process and supporting documents between fishermen and exporters should be traceable.
3. For fish caught by fishing vessels that are part of the "Taiwan Xingang Mahi-mahi Fishing Improvement Project", the catch logs for each fishing vessel and each voyage should be uploaded.
(II) For mahi-mahi imported to other countries, import certificates for the mahi-mahi products should be uploaded, and the certificates should be stamped with the seals of the importing company and the person in charge. If the exporter is unable to upload the documents as required in the preceding paragraph before export, the upload should be completed within fourteen days after the export of the goods.
V. If an application is submitted in accordance with the preceding paragraph and one of the following circumstances exists within one year prior to the application date, the export may not be approved:
(I) The application documents uploaded in accordance with the preceding paragraph are false or misleading.
(ii) Failure to upload files as required in item
(ii) above.
